B of A – Please Answer The Question
Critics say, even if B of A [Bank of America] has only been foreclosing on property owners that are late and after appropriate loan-modification attempts, B of A’s statements have just ignored the most pertinent question.
Rebel Cole, a law professor at DePaul University in Chicago, made a great point about B of A by saying, “They may have been accurate in that the borrower was delinquent,” “But what they don’t say is, ‘We have followed the law,’ and that is where the issue is.”
Cole states that in a lot of cases, the banks do not have the necessary paperwork to proceed with foreclosures. ”The genie’s out of the bottle on this one,” Cole says regarding B of A.
B of A Cut Corners
Last month, a letter from Ohio Attorney General Richard Cordray pointed out that B of A cut corners in what “would appear to amount to a fraud upon our courts.” Skeptics say that Bank of America’s apparent failure to abide by state property law could become a stumbling block for B of A as well as for JPMorgan Chase and Wells Fargo.
“The banks are trying to paper over this problem, but if you know the law, you know there is no easy way out of this,” Rebel Cole also stated regarding B of A and other bank’s issues.
Not everyone agrees that the foreclosure fiasco signifies a certain doom for the banks like B of A, which potentially face much larger issues with a still-sick housing market and a weak economic recovery.
Chris Whalen, of Institutional Risk Analytics, is one, because Whalen said, “In the scheme of things, this is not going to matter,” Whalen also stated, “We’ll see some bizarre trial decisions and the cost of servicing is going up, but this is not going to kill them.”
B of A Said They Aren’t Perfect
Last month, B of A conceded in a statement that “we’re not claiming perfection,” which is just as well because of the wrongful foreclosure nightmares that have come to surface of late. B of A has emphasized that it’s “committed to getting our process right.”
Bank of America, meanwhile maintains it’s going to resume foreclosures – though recently their statements have been more cautious.
On Oct. 18, B of A stated that it they are planning that “the first foreclosure affidavits will be resubmitted to the courts” by Oct. 25. However, they have modified that by saying it is “preparing to submit affidavits” in a process that “will take several weeks.”

Mortgage Modifications Don’t Help
Mortgage modifications didn’t help three year old Anthony, who often tells his mom Jill G., of Mesquite, Texas before he goes to bed: “I wanna go to the other house.”
Jill, Anthony and their dog, Tiffy a black Lab-mix, moved approx 12 miles to a rental after their home in Garland was auctioned away in a foreclosure auction. Jill tried, for close to a year, to get one of those mortgage modifications, only to have the rug pulled out because the approval was then rescinded. Bank of America Corp. said Jill had missing documents – papers that Jill said she sent.
Based on information from groups that help homeowners that have used mortgage modifications program, Jill’s ordeal has been repeated thousands of times. According to them, innocent hardworking homeowners still get evicted while participating in mortgage modifications specifically created to avoid foreclosures. The Home Affordable Modification Program was the target of hearings recently held for “trial” mortgage modifications that permitted debts to pile up and paperwork to ‘go missing’, which resulted in the seizure of homes.
Regarding Mortgage Modifications
Regarding mortgage modifications, Julia Gordon, senior policy counsel at the Center for Responsible Lending, in her Oct. 27 Congressional testimony stated, “Many homeowners end up facing foreclosure solely on the basis of the arrears accumulated during a trial modification,” she also said, “One incomplete payment or one accounting mistake can land you on an apparently unstoppable conveyor belt to eviction.”
Around one-half of the 1.4 million temporary or “trial” mortgage modifications granted since the inception in March 2009 of the program have been canceled, based on U.S. Treasury Department information. Less than 470,000 homeowners have gotten permanent mortgage modifications. A staggering figure is approx one in five of the canceled mortgage modifications is either in bankruptcy or foreclosure, according to a Treasury survey of the nation’s eighth biggest mortgage loan servicers, which handle billing, collections and foreclosures.
Shocking Info On Mortgage Modifications
Shockingly, even homeowners that do get approved for mortgage modifications and never miss a payment can still end up in foreclosure, the Office of the Special Inspector General for the Troubled Asset Relief Program, stated in an Oct. 26 report given to Congress. This report said, “They may face back payments, penalties and even late fees that suddenly become due on their ‘modified’ mortgages and that they are unable to pay, thus resulting in the very loss of their homes that HAMP is meant to prevent,”.

Foreclosure crisis: Federal Bailout Oversight Panel Raises Alarms
During a recent hearing members of a congressional panel responsible for monitoring the government’s bailout programs gave alarm and frustration over the possible repercussions of the home foreclosure crisis.
This hearing conducted by the bipartisan Congressional Oversight Panel was initially to examine the Treasury Department’s foreclosure prevention programs designed to help the foreclosure crisis. But panelists actually focused much of their attention on the fact that some of the nation’s largest mortgage Servicers regularly submitted faulty and fraudulent foreclosure paperwork.
Sadly, the foreclosure crisis continues to rise.
Sen. Ted Kaufman (D-Del.), the panel’s austere chairman said in opening remarks that the problems “are already undermining investor and homeowner confidence in the mortgage market, and they threaten to undermine Americans’ fundamental faith in due process.”
Foreclosure Crisis: Uproar
Recent month’s revelations caused lenders such as Bank of America, Ally Financial and J.P. Morgan Chase to stop foreclosures temporarily and giving some hope that the foreclosure crisis was slowing. The uproar also has triggered numerous state and federal investigations, which led more homeowners to challenge the legitimacy of their foreclosures and prompted large investors to threaten lawsuits and insist that big banks purchase back failing loans during this foreclosure crisis.
The head of the Treasury Department’s homeownership preservation office, Phyllis Caldwell, at the hearing called the behavior of the mortgage servicers “unacceptable.” Agency officials, she said, are examining the possible fallout and have insisted that Servicers follow the law. “We’re looking at the situation very, very closely,” Caldwell told the panel members. “At this point in time, there is no evidence that there is a systemic risk to the financial system.”
Foreclosure Crisis: Skeptical Members
However, some members of the panel appeared skeptical, noting that if lawsuits from large investors grows, big banks could lose billions. “It is not a plausible position that there is no systemic risk here,” said panel member Damon Silvers, director of policy and special counsel to the AFL-CIO.

The Center for Responsible Lending estimated that a whopping 2.5 million foreclosures would be completed during the first 3 years of the foreclosure crisis, which was be from January 2007 through 2009.
It is my understanding that these mortgages were taken out between the years 2005 and 2008 and the majority of these foreclosures were on Owner Occupied properties.
Per an article from Center for Responsible Lending:
• The majority (an estimated 56%) of families who lost homes were non-Hispanic and white, but African-American and Latino families were disproportionately affected relative to their share of mortgage originations.
• Among recent borrowers, experts estimate that nearly 8% of both African Americans and Latinos have lost their homes to foreclosures, compared to 4.5% of whites.
• The racial and ethnic disparities in these estimated foreclosure rates hold even after controlling for differences in income patterns between demographic groups.
As the title of this piece states it looks like this horrible situtation is far from over.
According to a press release in May 2010 from the Mortgage Bankers Association’s National Delinquency Survey (NDS), the proportion of mortgages in the foreclosure process [in the 1st qtr of 2010] is at a historical high of 4.63%.
