Most of the time someone that has been foreclosed on and lost their home has fallen prey to predatory lending practices used by banks and other lending institutions. With expert help you can have the following tips and secrets working in your favor to help you stop a foreclosure on your home and property, and keep your home. You can wind up even paying a lower principle loan balance and/or a lower interest rate or both due to receiving refunds and/or thousands even tens or hundreds of thousands of dollars in damages because “a bank/creditor” violated the law in the preparation and execution of your loan agreement.
Tip 1: As mentioned above due to the bank violating many laws and statutes in the preparation and execution of your loan you may be due many thousands of dollars in refunds and damages. The secret that bankers don’t want you to know is that by far the majority of the time they are in violation of laws that protect the borrower, the homeowner. Creditors hope people do not find out the majority of people who get real expert help can win their case against a bank’s predatory lending practices and stay in their home with the damages they received used to offset their delinquent payment amount. The home owner can even be paying on a lower principle balance and negotiate a lower interest rate due to refunds and damages being applied to their balance and bringing it down significantly.
Tip 2: The borrower or homeowner need not pay out a lot of money for attorney fees to win their dispute against a bank and stop foreclosure. When a borrower or any Truth In Lending statute compliance expert the borrower may hire finds the bank is in violation of Truth in Lending statutes, if they win in the dispute against the bank on even a small technical violation the bank must pay the homeowner’s attorney fees according to Truth In Lending provisions. Normally it is easy to win because banks have engaged in several, both small and big/material, Truth In Lending Act violations in the preparation and consummation of a loan and the attorney’s fees are covered by the bank as well as the borrower/homeowner receiving many thousands of dollars in damages.
Tip 3: The best and easiest way to stop a foreclosure is to challenge, counterclaim, and counter complaint the bank on the violation of laws and statutes that have been specifically setup to protect borrowers and home owners from fraudulent and predatory lending practices that bankers and other lenders have been found to engage in regularly. There are several such laws such as: Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), Home Ownership and Equity Protection Act (HOEPA), and Fair Debt Collection Practices Act (FDCPA) among others. Experts in these and other laws and statutes can help a homeowner like yourself mount a proper defense against a bank that has used predatory lending and is trying to foreclose on you the homeowner.
Due to the overwhelming need for help in stopping foreclosure where predatory lending is involved many times financial professionals like loan officers and mortgage brokers and financial planners and consultants, etc. are getting involved and connection with Truth in Lending and predatory lending experts and referring their clients who need help to stop foreclosure.
